Until recently, the NSW Code of Practice was practical guidance — evidence of what was “reasonably practicable.” Since 1 July 2026, that’s changed. The Code is now an enforceable compliance benchmark, and organisations that choose a different approach must be able to prove, in writing, that it delivers an equivalent or higher standard of protection.
That puts a new obligation on the people ultimately accountable for risk oversight: boards, executives and managers.
Regulators will expect evidence that:
Psychosocial hazards have been identified
Risks have been assessed
Controls have been implemented
Controls are reviewed and monitored
Decisions are documented
If you can’t show the evidence, regulators may conclude the controls don’t exist.
